Please read these Terms and Conditions carefully before submitting an inquiry or booking services with MakeupbySherryb LLC. By using this website or submitting an inquiry, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing this website or submitting a booking inquiry, you agree to these Terms and Conditions. These Terms constitute a legally binding agreement between you and MakeupbySherryb LLC (Atlanta, Georgia). We may update these Terms at any time; continued use constitutes acceptance.
2. Inquiries vs. Confirmed Bookings
Submitting the contact or inquiry form on this website is an inquiry only — it does not constitute a confirmed booking and does not create any contractual obligation.
A booking is considered confirmed only when both of the following conditions are met:
- Both parties have agreed in writing to the services, date, and terms; and
- A non-refundable deposit has been received and confirmed.
Until both conditions are met, your date remains available to other clients. We respond to inquiries within 48 hours on business days.
3. Booking Confirmation Process
Upon receipt of your inquiry, we will contact you to discuss availability, services, and pricing. To secure your date, the following steps are required:
- Review and sign a written service agreement.
- Submit the required non-refundable deposit.
Only after both steps are completed will your date be officially held.
4. Portfolio & Photo Usage
MakeupbySherryb LLC reserves the right to use photographs taken of completed work for portfolio, website, and social media (including Instagram) purposes.
- If you wish to restrict or prohibit photo usage, please notify us in writing before your event date. We will honor all such requests.
- All photographs remain the copyright of MakeupbySherryb LLC unless a separate written agreement is made with the photographer.
- Your notification to restrict usage does not affect any other term of your service agreement.
5. Service Fulfillment & Force Majeure
We are committed to fulfilling every booking. In the unlikely event that we are unable to fulfill a confirmed booking due to sudden illness, family emergency, or circumstances genuinely beyond our control:
- We will make every reasonable effort to provide a qualified substitute artist at no additional cost to the client.
- If no suitable substitute is available and the service cannot be performed, a full refund of all payments made will be issued.
- MakeupbySherryb LLC shall not be liable for any additional losses, costs, or damages beyond a full refund of fees paid in such circumstances.
6. Allergies, Skin Conditions & Liability
It is the client's responsibility to disclose any known allergies, skin conditions, or sensitivities before services begin. MakeupbySherryb LLC will take reasonable precautions but cannot be held liable for adverse reactions when the client has not disclosed relevant health information. Patch tests are available upon request.
7. Georgia State Law & Jurisdiction
These Terms and Conditions are governed by the laws of the State of Georgia, United States. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Fulton County, Georgia.
8. Limitation of Liability
MakeupbySherryb LLC's total liability for any claim arising from services rendered shall not exceed the total fees paid for those specific services. We are not liable for any indirect, incidental, special, or consequential damages of any kind, including but not limited to emotional distress, consequential financial loss, or damages from circumstances beyond our control.
